By accessing or using the Cre8tera platform located at platform.cre8tera.ai (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform.
Cre8tera provides a content creation and distribution platform that allows users to create, manage, and distribute content across social media platforms including YouTube, TikTok, Pinterest, and others. The Platform may include AI-powered tools for content generation and workflow automation.
To use the Platform, you must create an account. You agree to:
Certain features of the Platform require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
Payment processing is handled by Stripe. Your use of payment services is subject to Stripe's terms of service.
You retain ownership of all content you upload, create, or distribute through the Platform ("User Content"). By using the Platform, you grant Cre8tera a limited, non-exclusive license to process, store, and transmit your User Content solely for the purpose of providing the Platform services.

The Platform allows you to connect third-party social media accounts for content distribution. By connecting these accounts, you authorize Cre8tera to access and use the permissions you grant through each platform's OAuth authorization flow. You are responsible for complying with the terms of service of each connected platform.

The Platform, including its design, features, code, and branding, is the property of X10D AI Corporation and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our prior written consent.
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Cre8tera and X10D AI Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of your use of the Platform.
You agree to indemnify and hold harmless Cre8tera, X10D AI Corporation, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Platform, your User Content, or your violation of these Terms.
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination will survive.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
